The Prison Rape Elimination Act of 2003 was signed into law by President George W. Bush with the intent to provide protection for individuals from prison rape. The act also created the National Prison Rape Elimination Commission and charged it with developing draft standards for the elimination of prison rape. Those standards were published in June 2009, and were turned over to the Department of Justice for review and passage as a final rule. That final rule became effective August 20, 2012.

The Fremont Police Department is committed to providing inmates housed in our facility, the safest environment possible. The Fremont Police Department has a zero tolerance policy toward sexual abuse and sexual harassment of any kind. Inmates who are subject to any sexual abuse or sexual harassment are strongly encouraged to report the behavior. All complaints will be investigated thoroughly and completely, whether criminally or administratively, whichever is most appropriate.

Inmates experiencing sexual abuse or harassment may report the behavior to any detention employee, Fremont Police Department employee, or to a third party, such as friend or family member, attorney or advocate, who may make the report for them. Alternatively, reports may be made directly to the Highland Hospital Sexual Assault hotline at 510-534-9290.
