August 4, 2024, Fatal Hit and Run Traffic Collision

 On August 4, 2024, at approximately 8:40 p.m., Fremont Police Officers were dispatched to the area of Mission Boulevard (State Route 238) and Nursery Avenue to the report of a collision involving a pedestrian.  The reporting party said the pedestrian was down in the roadway. Fremont Police Department Officers and the Fremont Fire Department quickly arrived on scene and located the pedestrian. Unfortunately, the pedestrian was pronounced deceased at the scene. 

Officers learned the driver, later identified as Brian Gutierrez (29 years old, resident of Hayward), fled the scene on foot prior to police arrival. Officers began searching the area for Gutierrez. While officers were searching for Gutierrez, other officers were able to make contact with him via telephone. Gutierrez ultimately agreed to turn himself in to the police, and he was taken into custody a short time later.

The Fremont Police Department Traffic Investigations Unit responded and assumed the collision investigation. Based on the preliminary investigation, Gutierrez was traveling northbound on Mission Boulevard when he struck the east curb line, where the pedestrian was jogging. Gutierrez’s vehicle struck the pedestrian. Drug and alcohol impairment, as well as speed, are believed to be factors in this collision.

The Alameda County Coroner's Office responded to recover the decedent. The deceased pedestrian has not yet been identified.   

Gutierrez was arrested for Vehicle Code 20001(a) – Hit and run collision resulting in injury and Vehicle Code 23153(a) - Driving under the influence of an alcoholic beverage causing injury. Additional criminal charges are likely to be sought at the conclusion of the investigation. 

This is Fremont’s fifth fatal traffic collision in 2024.
